New deadline will be set if the delay is caused by justified circumstances

Chinese CRBC company will not pay penalties for missing the deadline for the construction of Smokovac-Mateševo highway section if the engineer establishes that demands of the contractor are justifiable due to force majeure – coronavirus pandemic.

Minister of Transport and Maritime Affairs, Mr Osman Nurković, and CEO of Monteput, Mr Jonuz Mujević, visited this highway section to check the level of realization and quality of works. They stated that works were 90% finished.

Mr Nurković said that even though the set deadline had expired, the contractor had to fulfill all other tasks.

The procedure of determining the justification of the submitted claim of the contractor regarding the event of force majeure (regarding COVID-19) is underway.

“After the engineer completes the procedure in accordance with the contractual procedure, it will be known whether or not the contractor is entitled to a justified extension of deadline. If the engineer finds that the contractor’s claim for force majeure (Covid-19) is justified, an annex to the Agreement with a newly determined deadline will be concluded “, the Ministry explained.

The deadline for completion of all works on the priority section from Smokovac to Mateševo expired on September 30, but a new annex to the contract has not been signed yet, because the supervisory body of the French-Italian consortium, Ingerop Geodata, is expected to decide on CRBC’s requests for the extension of deadline.

In addition to the works on the highway route, the Minister and his associates also visited the works on the Mateševo 110 / 20kW substation, which represents one of the two substations that will provide quality and stable power supply for the settlements that provide electricity and stability along the highway will also play the role of a backup power supply to supply electricity to consumers in the north of the state.

They also visited the works on the water source from which the entire section of the highway is supplied by water supply and which, in addition to supplying consumers on the highway, will also supply the surrounding settlements, and enable the development of the entire area along the highway.
