Telekom claims compensation for the damage caused by roaming prices

Montenegrin Telekom has sued Agency for Electronic Communications, claiming the compensation for damage and lost profit due to the application of, as they say, unlawful decision by means of which roaming prices have been reduced in the period from June 2015 to August of 2017.

Representatives of Telekom explain that the Agreement on the reduction of roaming prices from 2014 envisages the amendments in the domain of setting out authorizations by national regulators to determine roaming prices without market analysis. This obligation was neglected by the country, while the Agency has been rendering binding decisions.

Telekom representative, Tijana Vukčević, suggested yesterday at the preparatory hearing, financial and telecommunication expertise with the aim of determining volume of traffic and the damage caused by reduced prices. The damage is reflected in the money difference between the revenues that would be generated if the roaming was charged by previous prices and the revenues that had actually been generated.

In their statement of defense, Agency for Electronic Communications states that there is no need for the ratification of the Agreement since it is an administratively international agreement reached among the line ministries of four countries. The Agency was in charge of the implementation of the agreement and the establishment of the dynamics of the reduction of roaming prices. They claim that Telekom wants to maintain prices of their services and generate higher profit.

The court proceedings will resume in the middle of May.
