Ombudsman: Special forces violated rights of a handball referee – looking for Kaludjerovic, police broke into wrong apartment, his wife and children experienced stress

Last year, when they mistakenly broke into the apartment of Cetinje handball referee Bogdan Kaludjerovic in search of Nenad Neno Kaludjerovic, the officers of the Special Police Department (SPO) violated the referee’s rights. This is stated, among other things, in the opinion of the Protector of Human Rights and Freedoms.

Namely, Bogdan Kaludjerovic stated that on 13 April last year, the police broke into his apartment where he was with his wife and two minor children.

He points out that before that he heard a noise in front of the front door of the apartment where they live, they heard loud banging on the front door with shouts of “Open, police”.

Kaludjerovic, it is added, got up and went to the door while repeating the words “Please, take it easy, my children are sleeping”. After unlocking the door, he saw several members of the Special Police Unit, in full gear, with weapons pointed in his direction, and among them two with equipment for breaking doors.

The Ombudsman makes recommendations to the Ministry of Internal Affairs – the Department for Internal Control of the Police to effectively investigate the responsibility of the police officers who acted in specific situation, i.e. who violated the rights of the complainant by their actions, and to the Police Directorate so that in the future when conducting the search of apartments and other premises, officers of the Police Directorate should consistently apply police powers in accordance with international standards, the Law on Internal Affairs and the Criminal Code procedure, that is, accurately collect all the necessary data for the legal implementation of such actions.
